That sucks, here in australia he would have the book thrown at him heavilly, even if the burglar was armed and repeat offender, in australia unless the guy is armed with a gun or explosives you virtually cant touch him. Which is a shame, fact is that student would have never needed to do anything ........ if that burglar wasnt in his home in the first place ......... a shame thats forgotten these days.
I keep my steel blunt under my bed, that way an intruder might just run off if they know I got a sword, if they attack I can just slap n wrap them senseless.

One thing about living where I live is that you have the right to use deadly force to defend your self and your family from bodily harm, and a home intruder is automatically presumed to be intent on doing bodily harm.
Kill them on your front porch or in your yard- bad for you.
Let them step across the threshold first - bad for them.
I remember a local sheriff advising my dad to "drag him inside before you call us" if he ever shot an intruder.

Whats sad and pathetic about the laws is this kid is likely going to be charged with manslaughter... You know things are screwed up legally when someone defending himself becomes the criminal when they should be a hero.

im so glad i live some were that we can defend our homes. on serious side i truly hope that the kid is not mentally effected by all this. i doubt that he will be introuble with the law , as far as i know there is no law to get a license for a sword like a gun. and if he had just called the cops , that crackhead would have pry just broke bake in a month later.

Would assume the burglar (at the last moment) put his arm up to try and block himself as he saw the sword being swung at him.
It is a shame, but he probably is going to be charged at some level. Seeing that the garage is separate from the house, and the crook was not in any immediate position to do the students harm, they will probably charge him.

Thats not the first amendment... Also over the years numerous states passed laws protecting criminals... there are some states where it's illegal to do anythign except hide in your closet when someone breaks in. Despite that what he did was for the best... he'll likely get charged with something. Heck in NY if i were to kill a burglar with one of my swords, and I didn't wait for him to shove a knife or gun in my face... its premeditated murder. So unfortuantely I'm sure he'll be charged, I believe i read the DA is already assembling a case against him... because hes such a hardened criminal now like the man he killed.

But just like someone mentioned previously, you can't just kill anyone who steps foot on your property. They have to have entered your residence for them to be "fair game". Believe me, go back and look at my history on the subject, i am always on the side of fighting back against an intruder when your life is in danger. But in this case, the crook didn't really pose an immediate threat to the people in the house. When i try and put myself in that kids shoes, i can see why he would go after the crook. Having been burglarized a day of two before with some very expensive property being taken, the students were probably a little pissed... I would be too, and when that adrenaline gets pumping its often hard to think of consequences. You act & react second by second in that situation. I would guess, that the young man is already wishing he had just locked the doors and called the police.

One of which follows If someone is banging on my door in a threatning manner, and I cannot asses whether he is armed, I can defend myself and blow a hole in the door. However, if I come home and find a man in my living room holding a TV, I can do nothing but call the police. The only way I can use a handgun is if he is armed and brandishing. It must also be noted that no mattrer what, in NC, if you shoot and kill someone, you WILL be tried in court. Theres no such thing as self defense here, only justifiable homicide.

See in hippy town that is my home, a thief can walk into your home, grab your big screen TV and walk out and if you try to stop him, YOUR the criminal and you get charged with assault at the very least. Battery if you hurt the guy. Oh and the kicker...they can sue you if they get hurt while robbing you. I miss texas laws.

I know of at least one case where a burglar successfully sued the owners of a property he was breaking into... because he injured himself in the break in attempt. I lots a lot of respect for the law after learning that. Being from Monterey CA, I feel your pain. What I find most disturbing about this thing is how it seems this burglar was charged with pulling a weapon on police... but because one of the officers was unable to testify... because he was OVERSEAS SERVING OUR COUNTRY in the military, the charges where dropped. WTF?!?!? That flat out sucks. This guy should have been in jail, this whole thing should never have happened... I can't BELIEVE he got away with drawing down on cops because one of them could not get leave to testify. Unbelievable. If it happened as described... if the guy jumped the kid and he defended himself with the sword... man, I feel bad for him... because that could easily happen to me. I have more then once heard suspicious noises and grabbed a sword and went to investigate... had something come of it, I would have been placed in the same situation as this kid. Ugh.

I was actually researching this whole subject a couple weeks ago... seems liek there are very very few states that have laws the way they should be concerning home defense. Texas being one of them.
