I would say that's not OK. Seems LK has a bit of quality control issues with the Balaur stuff, a few rotated pommels and grips have shown up. The rotation I'd say depends, does it throw off your feeling for the edge? Then it's definately not OK. EDIT: It does look quite significant though. The chipped scabbard is another matter, if it is chipped it could be more than that underneath and not hold up. You can see there are a few cracks around as well...
In the end I'd say talk to KoA and don't let them BS you, it's not "standard grade" at minumum.

I'd say 100% the chip is inside the scabbard, and that's what's preventing you from being able to fully insert it. Can be as simple as turning it upside down and shaking it a bit, to needing to split it to get it out at the most complex. If you struggle at all, I'd send it back.
The peened on pommel isn't straight either, as you observe. I'd recommend as I did recently you try to use it either way and see if it's a problem for using. If not, you may want to keep it.
[Edit: from one photo I thought the hilt was off the centre axis, but I see that's just an optical illusion of the reflection off the guard]

I wonder if the missing chunk of wood from the scabbard is what's keeping it from going in all the way

Probably wedged in good if it's there, likely at the tip of the scabbard.

I know some saya makers have super long forceps or hooks to try and resolve this issue, having to split it being a last resort. If all else fails, send it back. They'll for sure be able to fix it at the factory (or just give you a new one).
I just checked my cold steel hand and a half sword, and a medieval dagger I have from darksword, and the pommel is a bit crooked on both (not as bad as the ones we've seen here recently, but not dead straight). I've cut with the cold steel though, and It felt fine (I didn't notice!). I also checked my inventory of authentic Japanese fuchi (not the highest quality, mind you!), and maybe 1-2/10 are dead straight, the rest the oval is slightly skewed relative to the blade. That's why I've always had to make seppa, it's impossible to tell it is crooked if the seppa matches the fuchi. So I think this is just one part of handmade, not everyone is Ford Hallam! If it's out enough you notice or it bothers you, you can always send it back. No guarantee the next one will be better!
