The tang should be a little softer overall so that it does not fracture.
This does not bode well for Cheness direct, two faulty swords

I would be getting a refund at this point. So many other vendors sell TH spring steel, I'd not waste a minute more of my time with this one.

Kind of agreeing with this. If you actually plan to use this sword as a sharpened pry bar then I guess a bent nakago(tang) isn't something to get worked up about. Bear in mind that obvious faults can be indicative of more serious flaws that cannot be easily seen, like a terrible heat treat. This sword didn't receive a lot of care during forging and construction, so be cautious.

+1. OP should get a refund. For sub-$300 spring steel, look at Huawei 9260, Hanwei Raptor (5160), and 9260.

From the "what to expect" on the Cheness site - "In the last 10 years, when the cost of a gallon of milk went from $1.47 to roughly $3.50, the price of our swords have remained exactly the same. "
Only the quality had dropped to maintain the profit margin

Ok. Maybe I should be a little more clear in exactly what I wanted out of this blade because "a sharpened pry bar" might not be too far off my expectations. Lol
I wanted to use this blade to test my own limits in cutting heavy targets. I've pushed the limits of the blades I currently have (mostly DH T10 blades)as far as I feel comfortable with without damaging my nicer blades. I wanted the Tenchi so I could push beyond these limits without fear of damaging a nicer blade. I don't mean for all out destructive testing but I wanted to take this blade just short of trying to cut down trees.
The Tenchi seemed perfect for this task. It makes no effort at being fancy but rather at being durable. And specifically a TH 9260 blade with heavy niku. But nite my concerns are for the temper as they obviously have poor qc controls in general. But if the tang is softer than the blade normally, this blade might be fine now that it's straight with the edge angle and tsuka in alignment.
Idk. I'm weary of going through the returns process again.
A secondary purpose I got this particular sword for was to use as a project sword. It has a poor polish and plain fittings. I was going to put my own polish on the blade, rewrap the tsuka, and maybe customize the saya. Unfortunately, if this blade can't serve it's first purpose, I doubt I'll be motivated enough to put in the time and effort to do the customizations.

If you're in need of an affordable heavy duty cutter, PM me. I might have something for you. I could even do all the custom work for you, if you want.
