Now, I know everyone's first response will be "duh, yes." However, I am looking at using 1040, maybe 1045 steel. This steel has a maximum quenched hardness of about Rc 52-56. I know Darksword tempers their swords to Rc53. Would a quenched but untempered 1040 sword be as durable, aka not brittle, as a quenched and tempered Darksword, if they both were RC53? Is brittleness a function of hardness, or is it different?

Even 1040-1045 wll need a temper. Temper at 400 for an hour should be sufficient. Even with such a low carbon steel, after the hard shock you will have to give it to get it to actually harden IE in salt brine or water, it will be under a lot of stress so atleast a single temper cycle is needed to remove any very HIGH stresses indced from the sever quench.
