Not on this forum but another popular sword forum I purchased a used katana made by Cheness from someone selling in the classifieds section. I paid the guy the agreed price over 20 days ago. Everytime I talk to him I get "been really busy with work, I'll ship it out tomorrow" etc.
Again over 20 days ago and he still hasn't shipped my sword, I am being very nice in my e-mails and e-mailing him every 4 or 5 days or so asking if he got a chance to ship my sword out yet. Every other time he replies and again tells me he is just busy and will ship it out the next day......
How long would you wait until making a "demand" and how long would you wait until filing a dispute with PayPal?
Should I wait any longer? Just asking everyone for advice here. I am trying to be nice and accommodating but the longer I wait and am nice about it the more I feel like a fool being taken for a ride.

10 days ago, be nice but firm. Then file with PayPal. Sounds like a "chicken stuck in the tail pipe" excuse to me.

Personally, I think the time is up.
I'm sure there has been some point during the last 20 days when he could have gotten this shipped. I would send one more email politely but FIRMLY requesting the blade be shipped complete with tracking number within a certain time frame or the deal is off and you will dispute the claim with paypal.
A few days to a week I can understand, but not 20.

If you paid over 20 days ago, then he doesn't ship within the next few days, inform him he has three choices: 1. Ship it within a few days 2. Refund you willingly 3. You file a formal complaint with Paypal and thus get your refund by force. Not shipping a sword that has been paid for after 20 days is rude and inconsiderate if he doesn't have a good reason like family illness or something. "Really busy with work" doesn't cut it unless he's been working everyday from dawn to dusk. It takes fives minutes to drop it off at the local UPS or postal office.

my father is a collector of hall of fame signed baseballs and someone tried this with him once. Long story short, your instincts aren't lying to you. Look around on this forum and you see genuine exchange of goods and money. The overwealming majority of these deals bring a sense of honor re: both parties, and in the end makes others comfortable going forward with future selling / buying. I'm a big fool at times, but your money is your money. Do what the other folks here have recommended and go get your money back. Best of luck also.

I bought 2 swords recently from a forumnite here and got them in 5 days. That's normal here and Sword Forum International. 20 days? Not acceptable.

I buy/sell/trade ALL the time... and 20 days and he has not even shipped it? Not acceptable at all. The only way I would put up with that is if it were someone I knew well and have delt with before... so I trust them implicitly... and they had a damn good reason. At 10 days I would have told him ship it and send me tracking info, or refund my money. If he did not respond withing 24 hours I would have wrote him again and said 'You have 48 hours to do as I asked or I file a paypal dispute.' then I'd follow threw. At 20 days, you have been more then patient with him... his time is up, now.

At 10 days, if he could not cannot prove shipping, I'd have initiated a claim with Paypal. He'd then have another 7 days to get it to me or the sale would be voided and our business would be concluded.
You are more patient than I would be.
He's either trying to scam you or he is a drop-shipping wholesaler that does not keep inventory at his home and his distributor is out of stock.
File a claim on his ass now. You only have 30 days to do so from the time of payment.

Yep, besides the fact that being down under I dont have the capacity to trade around with yanks this is why I tend to buy from reputable dealers with a very secure service KOA for example. I find it hard to trust outside of the safe retail bounds

Thank you everyone for the advice. I am usually impatient when it comes to buying things so that's why I was asking for advice, I wanted to make sure I had given this guy enough time before threatening to use the "dispute" hammer.
He did not reply to my e-mail from this weekend, I sent him one more this evening again asking nicely if he "got a chance to ship it".
If he doesn't reply to my last e-mail tomorrow I'll send him an e-mail saying if he is unable to ship my sword by Wednesday then to please refund my money. If he misses that deadline I'll inform him I'm filing a dispute with PayPal. I checked on PayPal and it said you have to file a claim within 45 days of payment.
If he would ship it it should get here the next day, we're in the same state, about an 8 hour drive away.

Yeah, I'd send him a final email stating that he has 24 hours to ship the sword and give the tracking number to you. If not, you will take the necessary steps with paypal to have your money refunded.

claim without hesitation, if you do not make your claim enough fast,, it will take forever for you to have the refund after that.

For me the gold standard is to ship the purchase immediately, but I understand that this is not always possible so I think 5 working days is a reasonable delay. 10 working days is the most I would wait, if I don’t have proof that its been posted within 10 days I would start kicking up a fuss.
If the guy had some reasonable excuse, like their child has been rushed to hospital then I might be more forgiving.
After 20 days, I would just demand my money back, I wouldn’t trust the guy and wouldn’t want anything to do with him.

When one posts something for sale in the exchange on the various forums, one assumes the responsibility for shipping it as soon as payment is confirmed. Either a PayPal transfer, or a Money Order in hand etc. Weekends and Holidays aside, shipping within 2 to 3 days is expected as standard procedure. This ammount of time allows the shipper to properly package the blade, or acquire the materials necessary to do so. This should be communicated to you by the seller from the time of purchase. 20 DAYS!!!!!!!!!!! Totally unacceptable, and not tempered in the slightest by the old "busy at work" excuse. Probably the most used and abused blow off line in use today among those who actually do have jobs. When you post something for sale on a forum, you assume the role of retailer as your job, part time or not, and you are expected to fulfill your obligations. You have been more than patient and accommodating by allowing this person to delay more than 5 business days. I would be suffering homicidal urges and uncontrolled shaking fits of rage after 20 days of "Meh, whenever"

When it comes to shipping, I think Yoda said it best. “Do or do not... there is no try.” Your clock is ticking on a refund. After 45 days, he can keep the money and the item. You should file straight away.

I agree with shoboshi and Miekka and everybody else.If its not in the mail in 7 days(more than enough time)Im pissed.I say 24 hrs from right now and time is up.And listen to Ronin Katana,times running out.Probably what this seller is waiting for.

Make sure to remind him that his "good name" will also be smeared on the forums if he doesn't rectify this situation to your satisfaction. Just the truth of course but in this circumstance the truth is enough of a smear. I hope it doesn't come to this.

tell him that if you do not recieve confirmation/tracking # in the next 24 hrs you will file with paypal-it smells like he's trying to outwait the 45 day period PP has-get on it or it will be really difficult to resolve once the claim period is exceeded.D
